The Working Group on Arbitrary Detention (WGAD) has issued Opinion No. 13/2022 concerning the case of Mr. Chau Van Kham (Viet Nam).
The WGAD found Mr. Chau Van Kham’s detention to be arbitrary under Category I, II, III and IV and requested the Government of Viet Nam to take the steps necessary to remedy the situation of Mr. Van Kham without delay and bring it into conformity with the relevant international norms, including those set out in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. The WGAD also found that there is a systemic failure to provide access to counsel during criminal proceedings in Viet Nam.
